Is ChatGPT GDPR Compliant for EU Businesses?
ChatGPT is not automatically GDPR compliant for EU businesses. OpenAI offers a Data Processing Agreement and an Enterprise tier with stronger controls, but using the standard API or ChatGPT consumer product with personal data from EU residents puts the compliance burden squarely on you. Whether you can make it work depends on what data you're sending to OpenAI's servers and why.
Why EU businesses keep asking this question
GDPR fines aren't theoretical. The Italian data protection authority temporarily banned ChatGPT in 2023 over concerns about lawful basis and data subject rights. France's CNIL and other EU regulators have since issued guidance making clear that AI tools processing personal data fall under GDPR's full scope.
Most SMBs aren't doing anything malicious. They're pasting customer emails into ChatGPT to draft replies, using the API to summarize support tickets, or building chatbots that collect user names and queries. Each of those workflows can constitute processing personal data under Article 4, which means GDPR applies whether you've thought about it or not.
What the rules actually require
GDPR requires a lawful basis for processing, a signed Data Processing Agreement with any processor you use, transparency to data subjects, and controls over where data is stored and transferred. OpenAI does offer a DPA for API customers and enterprise accounts. If you sign it and configure data retention settings correctly, you can build a GDPR-arguable case for certain use cases. 'Arguable' is not the same as 'compliant,' and no EU regulator has issued a blanket clearance for ChatGPT.
The bigger problem is data residency. OpenAI processes data in the United States. That means any EU personal data sent to the API crosses into a third country. The EU-US Data Privacy Framework, in place since 2023, provides a transfer mechanism, but OpenAI must be DPF-certified and your DPA must reference Standard Contractual Clauses as a fallback. Verify both before you proceed, because 'OpenAI is a big company so it's probably fine' is not a compliance position.
Special category data is where things break down fastest. Health information, financial data, political opinions, and biometric data carry stricter rules under Article 9. Sending any of that to a public API is very hard to justify under GDPR without explicit consent and a compelling legitimate interest. For regulated EU sectors like healthcare or fintech, the standard ChatGPT API is effectively off the table for personal data workflows.
When the answer changes
If you're using ChatGPT Enterprise, the controls improve. OpenAI doesn't train on Enterprise data by default, retention can be zeroed out, and the DPA is more explicit. For low-risk use cases with no special category data, a properly signed Enterprise agreement gets you closer to defensible compliance. It still doesn't make you automatically compliant. Your privacy notice, your lawful basis documentation, and your internal data mapping all have to hold up independently.
The answer also changes if you stop sending personal data entirely. Teams that use ChatGPT only for internal tasks like drafting generic content, writing code, or brainstorming with no personal data in the prompt aren't processing personal data through OpenAI and don't have the same GDPR exposure. The compliance question only bites when real personal data enters the request.
