Is OpenAI SOC 2 Compliant?
Yes, OpenAI has achieved SOC 2 Type II compliance, which means an independent auditor has verified that OpenAI's own internal security controls meet AICPA trust service criteria. That certification covers OpenAI's infrastructure and operations, not your application, your prompts, or the data you pass through the API. If your business is regulated, SOC 2 at the vendor level is necessary but not sufficient.
Why SMBs are asking this question
Security questionnaires for healthcare, finance, and logistics clients increasingly ask whether your AI stack is SOC 2 certified. When OpenAI is in that stack, the natural question is whether OpenAI's own certification transfers to you. It doesn't work that way, and the distinction matters.
SOC 2 Type II is an audit of a specific organization's controls over a defined period, usually 6 to 12 months. It tells you that auditors watched how that organization handled security, availability, and confidentiality in its own environment. It says nothing about what you build on top of that environment or how securely you configured it.
What OpenAI's SOC 2 Type II certification actually covers
OpenAI's SOC 2 Type II report covers the security and availability of OpenAI's platform: its data centers, access controls, incident response procedures, and employee security practices. Anthropic and Google have similar reports for their respective platforms. These reports are real and meaningful. They confirm that the vendor takes its own house seriously.
What the report does not cover: the prompts you send, the customer data your application passes to the API, the retention settings you configured (or forgot to configure), or any downstream system you connected. If you're sending patient names to a GPT-4 endpoint because your internal chatbot pulls from an EHR, OpenAI's SOC 2 report does not make that compliant. Your architecture is still the variable.
OpenAI also offers a zero data retention option for API users, which prevents training on your inputs. That's a meaningful control, but it requires explicit configuration and a separate data processing agreement. Neither of those happens automatically because OpenAI is SOC 2 certified.
When OpenAI's SOC 2 status isn't enough on its own
If you're in a regulated industry, SOC 2 at the API provider level is typically just the floor. HIPAA requires a signed Business Associate Agreement with every vendor that touches protected health information. OpenAI does not currently offer a BAA for its standard API, which means using the public OpenAI API with PHI creates HIPAA exposure regardless of their SOC 2 status. For HIPAA-covered entities, this rules out the public API entirely.
For non-regulated SMBs that just need to answer a client security questionnaire, pointing to OpenAI's SOC 2 Type II report is often sufficient, provided your own application handles data sensibly. The honest test is whether your app adds any security risk on top of what OpenAI's certified environment already controls.
